SMS Messaging Terms & Compliance
1. Program Description: This messaging program sends appointment confirmation and reminder messages to patients who have booked an appointment with WELLMIND HEALTH PLLC through our website, scheduling systems, or intake forms, and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms and intake documentation with dedicated consent for SMS communications. Messages include appointment reminders, scheduling confirmations, rescheduling updates, administrative communications, and care-related messages.
2. Cancellation Instructions: You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, provide consent as you did initially during intake or through our website, and we will resume sending SMS messages to you.

5. Message & Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your appointment schedule and service usage. For questions about your text plan or data plan, contact your wireless provider.
6. Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.
7. Age Restriction: You must be 18 years or older to participate in our SMS program, or a minor receiving services with legally valid parental/guardian consent.
8. Privacy Policy: For privacy-related inquiries, please refer to our Privacy Policy and Notice of Privacy Practices available on our website and provided during intake.
We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and HIPAA regarding the use of SMS communications and Protected Health Information.
General Terms
This website (the "Site") is owned and operated by WELLMIND HEALTH PLLC ("WELLMIND HEALTH," "we," "us," or "our"). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, Notice of Privacy Practices, and any additional terms and conditions that may apply to specific sections of the Site or to services available through the Site or from WELLMIND HEALTH PLLC.

Services Provided
WELLMIND HEALTH provides outpatient mental health services, including psychiatric evaluation, medication management, and related administrative and digital services. Services may include in-person and/or telehealth encounters where permitted by law.
Use of this website does not establish a provider-patient relationship until formal intake, informed consent, and confirmation by WELLMIND HEALTH.
Eligibility
You must be:
At least 18 years old, or
A minor receiving services with legally valid parental/guardian consent
Physically located in Utah at the time of service unless otherwise authorized
We reserve the right to refuse service where legally required or where service may not be clinically appropriate.
Telehealth Consent
By using telehealth services, you acknowledge and agree that:
Telehealth involves electronic communication of health information
Technical failures may occur and we are not liable for service interruptions caused by technology
Telehealth may not be appropriate for all conditions
Emergency services should be accessed via 911 in urgent situations
Telehealth is provided in compliance with applicable federal and Utah state laws
No Emergency Services
WELLMIND HEALTH does not provide emergency or crisis services.

A medical or psychiatric emergency

Protected Health Information (HIPAA)
Use of our services may involve the collection and use of Protected Health Information (PHI). PHI is handled in accordance with HIPAA and our Privacy Policy and Notice of Privacy Practices, which are incorporated into these Terms by reference. For privacy-related inquiries, please refer to these documents provided during intake and available on our website.
Payment & Insurance
You agree to:
Provide accurate billing and insurance information
Pay all applicable fees, copays, deductibles, or self-pay charges at the time of service or as otherwise agreed
Understand that insurance coverage is not guaranteed and verification of benefits does not constitute a guarantee of payment
Failure to pay may result in suspension of services or referral to collections where permitted by law. We reserve the right to charge fees for returned payments.
Cancellations & No-Shows
Appointment cancellations must be made within the timeframe specified in your intake documents and agreed upon at the start of services. Late cancellations or no-shows may result in fees not covered by insurance, as outlined in your intake paperwork.
Intellectual Property Rights
Our Limited License to You
This Site and all the materials available on the Site are the property of WELLMIND HEALTH PLLC and/or our affiliates or licensors and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal non-commercial use.
